We want to wish you all a very happy 4th<\/sup>. The year, 2011 is half over already. Time sure flies.<\/p>\n

Now that we\u2019re in summertime, we\u2019re busy gathering up a bunch of new material, writing, and gearing up for our early September appearance at Photoshop World in Vegas. We’ll post our schedule and topics there as we get closer.<\/p>\n

We\u2019ve also been busy writing for some publications like PPA\u2019s Professional Photographer magazine, which will be running our upcoming article on the Cariou v Prince infringement case. Appropriation and infringement will be taking up a bunch of our blog space here in the coming weeks.\u00a0 We love the work \u201cappropriation\u201d which to us is a euphemism for \u201cfive finger discount\u201d or just plain theft. The defense of \u201cfair use\u201d comes up a lot in these cases and we\u2019ll talk about why it usually doesn\u2019t work as an infringement defense, although the judge in the Cariou v Prince case had a great explanation of why it failed in that case. More on that later.<\/p>\n

Speaking of euphemism, you can also catch us in the current issue of Photoshop User Magazine<\/em> with our regular Copyright Zone <\/em>column.\u00a0 We love this month\u2019s topic, \u201cAd Speak\u201d where we break down definitions for such popular sayings in advertising such as: \u201cThe client really has no money\u201d<\/em>, \u201cThe agency has no money\u201d<\/em>, and the ever popular \u201cWe don\u2019t have Mercedes money\u201d<\/em> (Mercedes meaning any luxury brand in a category).\u00a0 Of course they all do have money. It just translates into YOU<\/strong> have no money.<\/p>\n

We also cover \u201cIt\u2019s not up to me\u201d<\/em> which translates to \u201cI do not have the guts or simple decency to look you in the eye and tell you the truth about anything\u201d. And of course the classic \u201cBe sure to keep me up to speed with your work\u201d<\/em> which means about the same as another classic \u201cThe check is in the mail\u201d<\/em>. And many more definitions and euphemisms.<\/p>\n

It\u2019s a fun piece, but we can\u2019t run the entire article right now. Feel free though to add anything you can think of to our \u201cAd Speak\u201d dictionary. We also call it \u201cArt Buyer Speak\u201d, \u201cWe\u2019ll talk you out of your socks Speak\u201d, or our favorite \u201cBaffling Speak\u201d which we shorten to just it\u2019s initials- BS.<\/p>\n
