{"id":650,"date":"2012-03-01T13:20:31","date_gmt":"2012-03-01T18:20:31","guid":{"rendered":"https:\/\/thecopyrightzone.com\/?p=650"},"modified":"2012-03-01T13:21:22","modified_gmt":"2012-03-01T18:21:22","slug":"whats-yours-is-mine-and-whats-mine-is-mine","status":"publish","type":"post","link":"https:\/\/thecopyrightzone.com\/?p=650","title":{"rendered":"What&#8217;s Yours is Mine, and What&#8217;s Mine is Mine."},"content":{"rendered":"<p>Seems that\u00a0the AP like virtually\u00a0all other syndicators, publishers, media conglomerates and corporations of whatever size and nature, get real testy when they perceive that their copyrights are being violated.\u00a0 They sic their minions of lawyers on the\u00a0alleged infringers with a vengeance.\u00a0 They rarely think twice before asserting what they believe, to be their constitutional\u00a0rights to valuable intellectual property.\u00a0 When the tables are turned however, these same\u00a0institutions using the\u00a0very same legal teams,\u00a0feign shock and surprise when you have the temerity to assert your claims of infringement against\u00a0them.\u00a0 After all, they think that what&#8217;s yours is theirs and and theirs is theirs.<\/p>\n<p>See for example this story in the Wall Street Journal: <a href=\"http:\/\/tinyurl.com\/74nqw6x\">http:\/\/tinyurl.com\/74nqw6x<\/a><\/p>\n<p>This is a case about which we have no comment at this time nor claim any &#8220;inside info&#8221;.\u00a0 We point you to it to demonstrate (only) the vigor with which the AP is pursuing what it perceives to be, justifiable intellectual property (IP) claims.\u00a0 Do these guys know something about the formula\u00a0(IP=$$) that you don&#8217;t?\u00a0 How come they get it but most creative people don&#8217;t despite our constant and frequent reminders?<\/p>\n<p>Three\u00a0part answer for those of you who avoided taking physics:<\/p>\n<p>Part 1:\u00a0 Intellectual Property Rights equals money frequently illustrated by use employing the shorthand IP=$$;<\/p>\n<p>Part 2:\u00a0 AP has money because it syndicates images created by you\u00a0guys for\u00a0fees and\/or commissions.\u00a0 Regardless of its tax status as a &#8220;not for profit&#8221;, money for their lawyers seems\u00a0readily available.\u00a0 These companies make money on your creativity. Perfectly legal and frankly, quite clever;<\/p>\n<p>Part\u00a03: If your work is registered with the Copyright Office, the financial playing field is substantially leveled by among other things, your ability to obtain legal fees and statutory awards in the event you settle or prevail on your claims.<\/p>\n<p>Unfortunately, too many creative people will read this, go \u201cTsk, tsk\u201d and not follow up and not do anything to protect their work, like registering their work. They then end up in Ed\u2019s office wondering what happened. What Ed wonders can\u2019t be repeated.
