Hi all, we’re doing a free live streamed Q&A on February 20th, 2018 from 4:00pm to 6:00pm ET at the B&H Event Space.
This should be very lively as there are a lot of issues floating around. We’ll do a short presentation in the beginning, quickly covering some recent topics like the new copyright registration changes taking effect February 20th. If you aren’t aware of these new changes to registering your photos, you could have your application rejected.

Jack and Ed, thanks for the informative Q & A.
I had a question as a result of something that was mentioned. Ed made the point that we should be wary of online image search services that demand 1st right of refusal to pursue any discovered infringements.
Given that almost all of the search services include this requirement for use of their service (with the exception of tineye, which itself is prohibitively expensive) how would you suggest staying on top of and discovering infringements without signing up with these services?
Perhaps you know of and recommend some services that are affordable and don’t require 1st right of refusal? I was not able to find any except for tineye.com.

Derek, Actually Ed and I are discussing this as Ed just sent me an article from someone who was signed with a small search only company which was then bought out by one of the large well known search and recovery companies that offer flowers and rainbows in their ad copy, but have serious clauses in their TOS you have to sign. Seems that if you use their search but not their recovery, but rather your lawyer or yourself privately, they will still bill you for their 50%. We’ll see if we can link to this 1st person account or post it.
At this point, TinEye and Google seem to be the only free and unencumbered search services we know of. Of anyone knows of another free or low cost search service that doesn’t tie you to their recovery services, please let us know. More than happy to pass it on.

Thanks, Jack. I appreciate it. A few months back I corresponded with the folks at Image Rights but their Terms of Service are incredibly, unbelievably skewed in their favor. So much so that after consulting an attorney friend of mine, I believe their terms would be characterized as a “contract of adhesion” and therefore be practically unenforceable in court. But who wants to take a chance on that, right?
I had a much better experience with the folks at Pixsy and their terms read much more reasonably, which was reinforced by correspondences I had with them. They appeared much less imperious and predatory than Image Rights. But they too require one to agree to 1st right of refusal.
Despite this I am seriously considering signing with them simply as the least bad option. Tineye is just way too expensive and manual google searches just not comprehensive enough I feel. Too easy to miss things. I figure, if they don’t handle an infringement case In a competent way, I can always disengage and re-assess my options. Not optimal but in my view the best available option at this time.
