Yes, well, they lost. In an order dated Sept 27, the Judge discussed 411(b), rejected plaintiffs arguments and left her original opinion in effect.
I think next up for the Defense was convincing the Judge the SOL “injury” rule is applicable in the S.D.N.Y. putting the last nail in the coffin.
