We want to wish you all a very happy 4th. The year, 2011 is half over already. Time sure flies.
Now that we’re in summertime, we’re busy gathering up a bunch of new material, writing, and gearing up for our early September appearance at Photoshop World in Vegas. We’ll post our schedule and topics there as we get closer.
We’ve also been busy writing for some publications like PPA’s Professional Photographer magazine, which will be running our upcoming article on the Cariou v Prince infringement case. Appropriation and infringement will be taking up a bunch of our blog space here in the coming weeks. We love the work “appropriation” which to us is a euphemism for “five finger discount” or just plain theft. The defense of “fair use” comes up a lot in these cases and we’ll talk about why it usually doesn’t work as an infringement defense, although the judge in the Cariou v Prince case had a great explanation of why it failed in that case. More on that later.
Speaking of euphemism, you can also catch us in the current issue of Photoshop User Magazine with our regular Copyright Zone column. We love this month’s topic, “Ad Speak” where we break down definitions for such popular sayings in advertising such as: “The client really has no money”, “The agency has no money”, and the ever popular “We don’t have Mercedes money” (Mercedes meaning any luxury brand in a category). Of course they all do have money. It just translates into YOU have no money.
We also cover “It’s not up to me” which translates to “I do not have the guts or simple decency to look you in the eye and tell you the truth about anything”. And of course the classic “Be sure to keep me up to speed with your work” which means about the same as another classic “The check is in the mail”. And many more definitions and euphemisms.
It’s a fun piece, but we can’t run the entire article right now. Feel free though to add anything you can think of to our “Ad Speak” dictionary. We also call it “Art Buyer Speak”, “We’ll talk you out of your socks Speak”, or our favorite “Baffling Speak” which we shorten to just it’s initials- BS.

Great column. It brings back all the bullshit I used to hear while in the biz. One you didn’t mention was this. “hey, we don’t have very much money for this one, but we will have a lot of work for you in the future”. Used often on those staring out, but it never goes out of style for photogs at all levels.
