I’m still a bit confused on “published” vs “unpublished.” If I had an image on my website 5 years ago, not for sale, but on a page listing award winning images, that is no longer on my new website, is THAT image considered “published?” There was no password to view the image, it was simply on a page of my old website, open for anyone to view, but not for sale.

Faith- Charging or not charging has no affect determining published or not published. The Internet has made the issue a bit confusing. Technically, it’s simply “presented to the public”, meaning if just anyone can see it, it’s published. But there are grey areas and the Copyright Office says in their instructions that they are letting copyright holders themselves to determine if a work has been published online. We’ll leave it at that.
