I run several Facebook groups and a guy who claimed he ran some type of fashion magazine was posting clips from this magazine. I noticed several of my fellow photographers images were in this online magazine and i asked the photographers and they had no knowledge there images were being used. I told this guy who claimed that owned this magazine that the images being used were under copyright infringement because the photographers who owned the copyright had no knowledge that images were being used. He then told me it is not infringement because the models submitted the images. Than it occurred to me the models even though they are in the images they don’t own the copyright unless they have some type of usage agreement with the copyright owner. I want to get clarification that under this situation the copyright owner is the only one who can use or submit images unless they have an agreement. 2nd this magazine owner needs to request an usage agreement before using any further images or he has a good chance of being sued is this correct. As you have stated in many of your tutorials that everyone thinks that they are an expert on this matter. I just want to make sure that i am correct and i don’t want to deal with people who are making serious mistakes especially when it comes to copyright infringement.

Yup, that’s correct. A model or subject in a photo has other rights, but not the copyright. A photographer would also need a release in this situation. If a someone used an image without the photographer’s permission or license, and there was a model in it, in most cases they could be sued by the photographer and the model in two separate lawsuits. Having permission from one does not grant you rights from both. Release laws (usually Rights of Publicity) are state laws and copyright is Federal law. While the release laws for models/subjects can vary, copyright is uniform across the country as it’s Federal law.
